1. Acceptance of Terms

By accessing or using the FidelityAI platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services. These Terms apply to all visitors, users, and others who access or use the Services.

2. Description of Services

FidelityAI provides an AI-powered evaluation and hallucination detection platform that includes:

• LLM output evaluation and risk assessment
• Hallucination detection and factual claim verification
• Compliance and regulatory checks (GDPR, EU AI Act)
• Domain-specific analysis across legal, finance, and biomedical fields
• AI chatbot with web-augmented retrieval
• Audit logging and evaluation history

3. User Accounts

To use certain features of the Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Services to:

• Violate any applicable laws, regulations, or third-party rights
• Submit or evaluate content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to the Services or related systems
• Interfere with or disrupt the integrity or performance of the Services
• Reverse engineer, decompile, or disassemble any part of the Services
• Use the Services to develop competing products or services
• Exceed rate limits or use automated tools to overload the platform

5. Intellectual Property

The Services and their original content, features, and functionality are owned by FidelityAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any content you submit for evaluation, but grant FidelityAI a limited license to process that content solely for the purpose of providing the Services.

6. Evaluation Results and Disclaimers

You acknowledge and agree that:

• Evaluation results are provided for informational purposes only and do not constitute professional advice (legal, medical, financial, or otherwise)
• Hallucination detection and compliance checks are AI-assisted and may not be 100% accurate
• You are solely responsible for verifying the accuracy and suitability of evaluation results before relying on them
• FidelityAI does not guarantee that all hallucinations, compliance violations, or risks will be detected
• Web search and retrieval results used during evaluation come from third-party sources and may not always be current or accurate

7. Data Processing and Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of information as described in our Privacy Policy. Content submitted for evaluation is processed in accordance with our data retention and security policies. We do not sell or share your evaluation data with third parties.

8. Rate Limits and Usage

The Services are subject to usage limits, including token-based rate limits for evaluation and chatbot features. We reserve the right to modify these limits at any time. If you exceed your allocated usage, access to certain features may be temporarily restricted until the limit resets.

9. Limitation of Liability

To the maximum extent permitted by applicable law, FidelityAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Services, any conduct or content of any third party on the Services, or any content obtained from the Services.

10. Indemnification

You agree to defend, indemnify, and hold harmless FidelityAI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party rights.

11. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.
